About the Director Disqualification Register

A person with a director disqualification is temporarily not allowed to be a director. Find out who has a director disqualification so that you can do business safely and responsibly.

What is a director disqualification?

A director disqualification is a temporary measure issued by a judge to a person. It only happens in special cases. Think of serious mismanagement or bankruptcy fraud. Someone who is disqualified may not be a director of a legal entity. Nor may they hold a similar position for a company. KVK registers all criminal and civil law director disqualifications in the Director Disqualification Register.

Why the Director Disqualification Register?

The Director Disqualification Register shows you who has been disqualified. And for how long. If you know who has a director disqualification, you can make an informed decision about who you do business with. This means you can act responsibly and do business safely.

What happens when a director is disqualified?

KVK keeps track of those who have been banned from running a business under criminal or civil law in the Director Disqualification Register. KVK also removes the disqualified person from the Business Register. And we will not register this person as a new or existing legal person while the ban is in force. Business Register products, such as an extract, do not show that a director has been deregistered due to a director disqualification. Their name is not shown. However, their disqualification can be seen in the Director Disqualification Register.

What is the process?

KVK receives information on director disqualifications from the court. We process this data within 2 working days in the Director Disqualification Register. We update the register every day.

You can only view director disqualifications from 1 October 2024 onwards. This is because a new law applies from that date. That means it is now allowed to view information about these bans. In addition, director disqualifications are temporary. You can only see it in the register if a director disqualification is currently in force.

What you cannot see

Some information is not shown in the Director Disqualification Register. For example, the type of director disqualification: civil or criminal. Or conditions and exceptions of such a disqualification. You can find this information at www.rechtspraak.nl (in Dutch). Use the case number or the European Case Law Identifier (ECLI) number of the court ruling to find out more about the disqualification.

A court can also impose a director disqualification when it bans a legal person. You will only be able to view these types of bans in the Director Disqualification Register once the law has been amended. KVK does deregister a person with such a ban from the Business Register. And we will not register them for a new or existing legal entity either.

Non-public part of the Director Disqualification Register

KVK is still developing the non-public part of the Director Disqualification Register. In the future, organisations that check whether individuals comply with a disqualification will be able to apply for authorisation to view non-public data about director disqualifications.

Frequently asked qustions about the Director Disqualification Register

You can only see director disqualifications of persons who received such a ban from the court on or after 1 October 2024.

No, you may not store, enrich, or share data from the Director disqualification Register. A director disqualification is temporary. If such a disqualification ends, it is no longer public. If someone stores, enriches, or shares this data, a person may remain linked to a director disqualification that no longer applies.

The court can impose a director disqualification. This happens, for example, in cases of bankruptcy fraud or serious mismanagement. If a company goes bankrupt, this does not mean that the board is guilty of this. Perhaps the company went bankrupt because the board made an error of assessment, for example. Or they had bad luck, like during the pandemic period.

The Director Disqualification Register is not part of the Business Register. That is why you can only see director disqualifications in the Director Disqualification Register, but not in our Business Register products.
